Liberandum halal verdict

Suitable with care

Not suitableSuitable

Gemini is a US-regulated exchange (New York trust company) where spot buying and selling with immediate settlement is available. As of September 2026 it has left the UK, EU and Australia and does not serve the Gulf states. It has no Shariah-certified product or Shariah token screening, so a Muslim user must stick to spot trades in halal coins and avoid staking-for-yield, derivatives, prediction markets and credit products.

Use

  • Spot trading, halal coins only

Avoid

  • Staking, lending, credit
  • Derivatives, predictions
More details

Spot trading on Gemini (the app's Buy/Sell and ActiveTrader) settles immediately against the user's own balance, which meets the AAOIFI requirement of hand-to-hand exchange for currencies (Shariah Standard No. 1) and the settlement conditions of Shariah Standard No. 20. Gemini also offers or is building products a Muslim user should avoid: prediction markets on its CFTC-regulated exchange Gemini Titan, cleared by Gemini Olympus (these are wagers on outcomes and fail the maysir test), planned futures, options and perpetual contracts, staking and a credit card. The former Gemini Earn programme was a lending product with a fixed return (riba); it was frozen in November 2022 when its partner Genesis halted withdrawals. Under a February 2024 settlement with the New York Department of Financial Services (NYDFS), Gemini paid USD 37 million and contributed USD 40 million to the Genesis bankruptcy, and in May-June 2024 Earn users received 100% of their assets back in kind (about USD 2.18 billion). The CFTC's USD 5 million January 2025 settlement over earlier statements is, as of September 2026, the subject of a joint motion to vacate filed in May 2026. Gemini has no Islamic account, no Shariah-certified earn product and no Shariah screening of listed tokens, so each coin must be checked separately. Reliability is moderate (6.2/10): strong US licensing plus a Singapore MAS licence (September 2026), SOC 1/SOC 2 Type 2 examinations by Deloitte and ISO 27001, customer assets held under New York trust law, but no regular public proof-of-reserves attestation and no disclosed reserve fund. Availability is narrow for Muslim-majority markets: Gemini's list covers Turkey and Egypt (without local licences) but not the UAE, Saudi Arabia, Indonesia or Malaysia, and UK and EEA accounts were closed on 6 April 2026.

No dedicated halal product

Gemini offers no Islamic (swap-free) account and no Shariah-certified earn or staking product. Its former Gemini Earn programme was a lending product with a promised return and was discontinued after the Genesis freeze in November 2022; its current staking and credit products are not Shariah-certified.

No token screening

Gemini does not screen listed tokens for Shariah compliance. Its listing review is a general legal and risk review, not a Shariah screen, so each coin should be checked on Liberandum before buying.

Step by step

How to trade halal on Gemini

  1. Create an account and verify your identity

Sign up at gemini.com or in the Gemini app from a supported country and complete identity verification. Enable two-factor authentication with a hardware security key if you can, and turn on address allowlisting for withdrawals.

  2. Deposit fiat without interest-bearing products

In the US, deposit USD by ACH or wire (both free). Avoid funding with the Gemini Credit Card or any borrowed money. Do not move funds into staking or any product that promises a return.

  3. Check each coin on Liberandum first

Gemini does not screen tokens for Shariah compliance. Before buying, look up the coin's halal status on Liberandum and skip coins rated non-compliant or doubtful.

  4. Buy with spot orders only

Use Buy/Sell in the app or spot order books in ActiveTrader, where the trade settles immediately against your own balance. ActiveTrader has much lower fees than the simple app flow.

  5. Avoid derivatives, predictions and yield products

Do not use perpetual contracts or other derivatives, Gemini Predictions (wagers on outcomes), staking for fixed yield or any lending product. These fail the Shariah conditions on settlement, gharar, maysir or riba.

  6. Withdraw to self-custody

Move long-term holdings to your own wallet. Crypto withdrawal fees are dynamic and shown before you confirm; ACH withdrawals are free and USD wires cost USD 25.

Reliability in detail

Overall 6.2 of 10

  • Proof of reserves

    4.0

Gemini states customer assets are held 1:1 and publishes audited financial statements (latest December 2025), but as of September 2026 its Trust Center lists no regular proof-of-reserves attestation with a Merkle tree for user verification.

  • Licences

    8.0

NYDFS limited-purpose trust company, money transmitter licences in 48 US jurisdictions, CFTC DCM (Gemini Titan, December 2025) and DCO (Gemini Olympus, April 2026), and a MAS Major Payment Institution licence for Gemini Digital Payments Singapore (September 2026). MiCA (MFSA, August 2025) and UK FCA authorisations lost relevance after the April 2026 exit.

  • Incident history

    6.0

Gemini Earn assets were frozen from November 2022 after Genesis halted withdrawals; users got 100% back in kind by June 2024. NYDFS fined Gemini USD 37 million (February 2024) over Genesis due diligence. The USD 5 million CFTC settlement of January 2025 is subject to a joint motion to vacate (May 2026).

  • Segregation of funds

    8.0

Gemini Trust Company is a fiduciary and qualified custodian under New York Banking Law; Gemini says customer fiat and crypto are held in accounts segregated from its own. Controls are covered by Deloitte SOC 1 Type 2 examinations, but no public reserve attestation confirms balances.

  • Insurance fund

    3.0

No user protection fund is disclosed, and Gemini's own security and Trust Center pages state no insurance coverage amount as of September 2026.

  • Security practices

    9.0

Mandatory 2FA with hardware key support and withdrawal address allowlisting; SOC 1 Type 2 and SOC 2 Type 2 examinations by Deloitte (latest period to 30 September 2025), ISO/IEC 27001:2022, PCI DSS and annual penetration testing. No hack of the exchange found.
